Terms & Conditions For PatioGear.co.uk
1. GENERAL
The terms and conditions set out below are applicable to the supply of products made by PatioGear.co.uk to the buyer, hereafter referred to as the Customer.
2. PRIVACY
2.1 We do not send random marketing e-mails to personal e-mail addresses (SPAM).
2.2 We do not make use of Cookies.
2.3 We do not collect information deemed "sensitive" under the Data Protection Act 1998. Your address details (but NOT your credit card details, see below) are retained on a restricted access system within our internal systems which is in keeping with both our security policy and the law.
3. PRICING
3.1 All prices are quoted in Pounds sterling.
3.2 All prices are inclusive of carriage charges for delivery to all U.K. mainland destinations.
3.3 Carriage charges to all other destinations other than the U.K. mainland are available upon enquiry with PatioGear.
3.4 Pricing is displayed clearly at the time of purchase and is not subject to change once the order has been placed with PatioGear.
3.5 Prices shown are subject to review without prior notice being given and are valid at the time of viewing.
3.6 If, in error, we have incorrectly priced an item, we will not be liable to supply that item to you at the stated price, provided that we notify you before we despatch the item to you. In those circumstances, we will notify ythe Customer of the correct price so a desicion can be made whether or not to proceed with the order at the relevant price. If you decide not to order the item, we will give you a full refund on any amount already paid for that item in accordance with our refunds policy.
4. PAYMENT
4.1 Payments must be made in Pounds sterling only, unless otherwise specified, by one of the following payment methods:
Major credit cards as listed: MasterCard, Visa, Switch, Solo, Visa Delta.
Cheques made payable to PatioGear.
Bank transfer direct to PatioGear.
4.2 PatioGear does not retain your credit or debit card details on its systems. When you reach the page for entering your card information, you are connected directly to the Protx secure server - you can tell this by the change in the web address on your browser. Protx are our payment service provider, and will process any charges or refunds to your card. We use Protx (www.protx.com) because they offer the leading industry standard in secure payment transactions, and they are one of the largest Internet payment service providers in Europe
5. TRANSFER OF RISK
The risk in the goods shall fully pass to the Customer once the goods have been delivered by our nominated transport provider and signed for.
6. DELIVERY
6.1 SHIPPING:
All products are despatched from our warehousing facilities. Unless requested by the Customer, all products must be signed for at the time delivery is made. The Customer must request any alternative delivery method at the time of the ordering and goods will be despatched at the Customers own risk.
6.2 SHIPPING CHARGES:
All the products contained on our website are delivered free of charge to the vast majority of the U.K. mainland. For deliveries to Northern Ireland, Southern Ireland and the Scottish Isles & Highlands additional carriage charges will be applicable. Please call us to confirm these charges prior to ordering.
6.3 DELIVERY DATE:
PatioGear aim to deliver all goods within four working days from processing of payment. Despatch normally takes place on the same day as payment is processed. Any orders which will exceed 28 days to fulfil, the Customers will be notified in writing and will be offered the option of order cancellation or a full refund of payment. Any products not available at the time of ordering will be despatched to the Customer as soon as is possible.
6.4 EXPRESS SHIPPING
In many cases we are able to ship orders on a "Next Day" delivery basis for an additional charge. If you require this service please enquire with us to confirm the availability of the product and the additional cost for transportation prior to ordering.
7. ACCEPTANCE
The Customer shall inspect the goods within a reasonable time period after delivery, and shall be deemed to have accepted the goods, unless, within a reasonable time period after their delivery the Customer notifies PatioGear that the goods are rejected. If no notification of rejection is received, PatioGear will consider the products being as described, of satisfactory quality and fit for purpose and therefore reserve the right not to accept any rejection of goods at a later date.
8. RETURNS PROCEDURE
8.1 If the goods are rejected within the time scale as defined in clause 7, the Customer shall comply with the PatioGear returns procedure as defined below. PatioGear will not accept any returned goods should the returns procedure not be followed.
8.2 The Customer must contact PatioGear by either telephone (on 02476 468888), by e-mail (contact@patiogear.co.uk) or in writing (PatioGear Ltd. P.O. Box 3376 Coventry CV4 9ZX) to obtain a returns authorisation. A returns code will be issued and must be referred to in all correspondence. This number must also be clearly marked on any returned packages. PatioGear will arrange for the relevant packages to be collected from the Customer. A collection charge will apply to returns where goods are not damaged or faulty.
8.3 In cases where the faulty or damaged goods are rejected within a reasonable time, the Customer is entitled to a full refund or replacement. The faulty or damaged product/s will be collected by PatioGear at our cost. Refunds are made within 30 days of cancellation.
9. CANCELLATIONS
9.1 By law, customers in the European Union have the right to withdraw from the purchase of goods ordered within seven working days (often referred to as the "cooling off period") from the date the item is delivered. To cancel your purchase within the seven-working-day cooling-off period, please contact us by either telephoning us on 02476 468888, by writing to us at the following address stating the reason for the return (this information is to assist us with the processing of your return). 9.2 Please note that we are unable to accept returns if you deliver them to us by hand.
9.3 For your protection, we recommend that you package the relevant item(s) securely using sufficient packaging materials (normally the original transit packaging will be sufficient) and return it to us using an appropiate method of transportation so that we receive it within seven working days of the day after the date that the item was delivered to you.
9.4 Please note that you will be responsible for the costs of returning the items to us unless we delivered the item to you in error, or if the item is damaged or defective. If we do not receive the item back from you we may arrange for collection of the item from your residence at your cost.
9.5 You should be aware that once we begin the delivery process you will not be able to cancel any contract you have with us for additional services carried out by us (eg: next day delivery) as this service forms part of a separate contract contract with us and by its very nature needs to be applied before goods can be shipped.
10. GAS CYLINDER DEPOSITS
10.1 Gas cylinder deposits are recoverable using a sliding scale tariff based on the initial charge as defined below:
Sum equal to 50% of the initial deposit if use of the cylinder is terminated within one year.
Sum equal to 30% of the initial deposit if use of the cylinder is terminated within two years.
Sum equal to 20% of the initial deposit if use of the cylinder is terminated within three years.
10.2 No further rebates are recoverable after three years.
10.3 No rebate can be refunded until the customer has returned the cylinder/s into the physical possession any authorised FloGas dealer and proof of the return has been received by PatioGear from the customer.
11. LAW
These terms and conditions are governed and shall be interpreted in accordance with U.K. Law.
